In contrast to work that addresses the relationships between international humanitarian law (IHL) and international human rights law, there is relatively little judicial practice or scholarship addressing how IHL interacts with crimes against humanity. If it is easy to understand how conduct that breaches IHL may also give rise to liability for crimes against humanity, it is more difficult to trace how conduct that appears to comply with IHL – in particular in the conduct of hostilities – interacts with the law of crimes against humanity. In this talk, I sketch some possible relationships and interactions between the two bodies of law.
